How long is there to deal with an inheritance?
The deadline for paying inheritance tax in Spain is six months from the date of decesease. After that, the tax authority applies surcharges and interest. Starting the process early avoids fiscal complications and keeps assets unblocked.
What happens if there is no will?
Without a will, the estate passes under the rules of intestate succession: the law determines who inherits based on the degree of relationship. The process requires a declaration of heirs which, depending on the case, is processed before a notary or a court. It is manageable, but needs to be done properly from the outset.
Can a will be contested?
Yes, in certain circumstances: if the testator lacked mental capacity when they signed it, if undue influence can be shown, or if the will infringes the forced heirs' entitlements (legítimas). It requires solid evidence and a careful assessment of the case, but it is viable where there is a legal basis.
