Shared Custody
This is not about dividing time 50/50. It is about defining precisely how both parents are going to be present in their children's lives: which weeks, handovers, bank holidays, schools, health decisions. If there is willingness to agree, I help make that agreement solid. If there is not, I defend what is right before the court.
Sole Custody
There are cases where shared custody is not viable or in the child's best interests. The argument has to go directly to what the child needs: their stability, their environment, their relationships. That requires a careful analysis of each situation.
Contact Arrangements and Parenting Plan
A well-designed parenting plan prevents conflict before it happens. It sets out time arrangements, communication, holiday sharing and protocols for joint decision-making. Without that level of detail, any minor disagreement can escalate into a much bigger problem.
Custody for unmarried parents
The fact that there was no marriage does not make custody less important or more straightforward. Judicial regulation is equally necessary. Without it, neither parent has legal backing when dealing with the school, healthcare providers or any decision affecting the child.
Grandparents' Right of Contact
Spanish law recognises the right of grandparents to maintain a relationship with their grandchildren. When that right is being blocked, there is a specific legal process to protect it, and in certain circumstances it can be pursued on an urgent basis.
Change of address for minors
Moving a child to another city or country is not a unilateral decision, even if it is taken by the parent who has custody. A change of residence affects visiting arrangements, schooling and the child’s relationship with the other parent, and requires agreement between both parents or, if no agreement can be reached, court authorisation.
If you wish to move house, the sensible thing to do is to try to reach an agreement and, if this is not possible, to apply for a variation of the arrangements before the move. Doing so afterwards may result in an order to return the child or, if the destination is another country, in proceedings for abduction.
If you object to the transfer proposed by the other party, there are ways to regulate or prevent it, but speed is of the essence.

Can custody arrangements be changed if circumstances have changed?
Absolutely. A change of residence, a significant change in employment, new needs of the child, or repeated breaches of the visiting arrangements are sufficient grounds to apply to the court for a variation.
