How much child support can be claimed?
The amount depends on both parents' income and the needs of the child. There is no fixed figure, the judge assesses each case individually. What can be done is to document both parties' financial situation thoroughly so the outcome is proportionate and difficult to challenge.
What happens if the other parent does not pay?
Non-payment is a breach of a court order. There is a civil route to recover the outstanding amounts and enforce the judgment, and in repeated cases it can give rise to a criminal charge.
Can the payment be reduced if I lose my job?
Yes. A significant change in income is sufficient grounds to apply to the court for a modification. It is worth starting the process as soon as possible, because any change only takes effect from the date the application is filed, not from when the change in circumstances occurred.
Are extraordinary expenses separate from the monthly payment?
Yes. The monthly maintenance covers ordinary costs. Extraordinary expenses (uncovered medical costs, after-school activities, school materials) are dealt with separately and are usually split 50/50.
