You do not need to be in the middle of a divorce to benefit from mediation. Unmarried couples who want to regulate their situation without going to court, or families who need to make joint decisions but communication has broken down, can also use the process.
Difference between mediating and litigating
Court proceedings give you a ruling. Mediation gives you an agreement that you and the other party have built together, shaped around the specifics of your situation, and with full legal validity.
What mediation does not do: it is not couples therapy, it does not require anyone to concede what they are not willing to concede, and it does not work if one party is not genuinely willing to participate. If I conclude that a case is not suitable for mediation, I will say so in the first session.

I am bar member nº 1595 of the Ilustre Colegio de Abogados de Orihuela and a member of the Spanish Association of Family Lawyers. I hold a qualification in Family Mediation accredited by the Ministry of Justice, and have spent over 20 years working on family cases in Torrevieja and the Vega Baja.
If in the first session I conclude that the case is not suitable for mediation, I say so plainly. And if it is, I take care of everything: the process itself and the formalisation of the agreement.

What if the other party does not want to mediate?
Mediation requires both parties to participate voluntarily. If one of them is not genuinely willing, the process cannot move forward and the court route is the alternative. Before ruling it out, an individual information session for each party can sometimes be worth trying.
Is the mediation agreement legally binding?
Yes. Because I am also a lawyer, I take care of formalising it before the court or before a notary, as appropriate, without you needing to go to another professional.
What happens if we do not reach an agreement?
The mediation process is confidential: nothing discussed in the sessions can be used in any subsequent court proceedings. If no agreement is reached, the contested route remains open and the mediation will not have weakened either party's legal position.
How much does family mediation cost in Torrevieja?
